Why do we review construction?

To preserve our community's feel and to comply with the restrictive covenants:



IV. Purpose of Restrictions

The purposes of restrictions on development are to ensure the use of Chestnut Acres communities for attractive residential purposes; to prevent nuisances; and to prevent the impairment of the attractiveness and value of the property. (ref. Restrictive Covenants Section I)

V. Required approvals

Ref. Restrictive Covenants, Section VIII.I

“No improvement of any kind, including and without limitation, any building, fence, wall, screen enclosure, sewer, drain, disposal system, driveway, decorative building, landscape devise or object, or other improvement shall be commenced, erected, placed or maintained upon any lot, nor shall any addition, change or alteration therein or thereof be made unless and until the plans, specifications and location of same shall have been submitted to, and approved in writing by the Developer. All plans and specifications shall be evaluated as to harmony of external design and location in relation to surrounding structures and topography. ... Any change or modification of approved plans shall not be deemed approved unless a resubmittal is made and written approval thereof is granted.”


Upon withdrawal of the developer and formation of the Chestnut Acres Property Owners Association in November 2001, the approval function devolved to the Environmental and Architectural Review Board of the Chestnut Acres Property Owners Association.

VI. Procedure

The POA Board encourages any property owner considering making improvements to contact the EARB early in the planning process. Questions regarding restrictions, the approval process, or status of a particular review should be directed to Chestnut Acres POA President.


To obtain approval for proposed improvements, please submit the following:

  •  Application for Approval form
  •  Appropriate plans and specifications for the proposed improvements
  •  A copy of your restrictive covenants, and
  •  Assurance that plans or contracts for proposed improvements includes provisions for protection of subdivision roads (check box on form).


A performance bond may be required of the contractor or property owner.


The EARB will review the request and respond within 30 days of receipt. The EARB will contact the property owner if more information is required.
